Disgraced Hollywood movie mogul Harvey Weinstein was hospitalised on April 27 upon his return to New York after the city’s highest court overturned his 2020 conviction on sex crime charges.

“The NYC Department of Correction has determined that Weinstein is in urgent need of medical attention,” his lawyer, Arthur L. Aidala, told AFP in a statement.

“Harvey is undergoing a myriad of tests and is being kept under observation.”

Police told US media that Weinstein has been taken to Bellevue Hospital in New York.

On Thursday, the city’s appeals court found that the trial judge had erred in admitting testimony from additional women who Weinstein allegedly abused but were not named in the allegations against him, and ordered a new trial.

The bombshell allegations against the Oscar-winning producer in 2017 launched the #MeToo movement, which paved the way for women to fight against sexual violence in the workplace.

Weinstein, 72, was convicted in a New York court in 2020 of raping and sexually assaulting former actress Jessica Mann in 2013 and forcibly performing oral sex on former production assistant Mimi Haleyi in 2006.

He was later sentenced to 23 years in prison.

Harvey Weinstein’s lawyer said Saturday that the one-time movie mogul has been hospitalized for multiple tests after returning to New York City after an appeals court overturned his rape conviction in 2020.

Weinstein was taken to Manhattan’s Bellevue Hospital after arriving at the city’s jails on Friday, attorney Arthur Aidala said.

They checked him out and sent him to Bellevue. He looks like he needs a lot of help physically. He has a lot of problems. He’s getting all kinds of tests. “Health-wise he’s a bit of a train wreck,” Aidala said.

A message left at the hospital was not immediately returned Saturday. Frank Dwyer, a spokesman for the New York City Department of Correction, said only that Weinstein was in custody at Bellevue. Thomas Malley, a spokesman for the Department of Correction and Community Supervision, said Weinstein had been turned over to the city’s Department of Corrections in accordance with the appeals ruling. Weinstein had been held at Mohawk Correctional Facility, about 100 miles (160 kilometers) northwest of Albany.

On Thursday, the New York Court of Appeals threw out his conviction after concluding that the trial judge had allowed jurors to see and hear too much evidence that was not directly related to the charges he faced. It also threw out his 23-year prison sentence and ordered a retrial. Prosecutors said they intend to try him again on charges that he forcibly performed oral sex on a TV and film production assistant in 2006 and raped an aspiring actor in 2013.

Weinstein remained in custody even after the appeals verdict because he was convicted of another rape in Los Angeles in 2022 and sentenced to 16 years in prison. Weinstein has been suffering from a variety of ailments for some time, including cardiac problems, diabetes, sleep apnea and eye problems.

Aidala said he spoke to Weinstein on Friday afternoon as he was being driven from an upstate prison to New York City, less than 24 hours after the appeals verdict, which was released Thursday morning. While his client’s ailments are physical, he said mental ones are much more intense. Feet firmly planted on the ground.

The lawyer said it usually takes a week or two for state corrections and prison officials to arrange for an inmate to be transported. He was not treated well. They did not even give him a sip of water, nor food, nor let him go to the bathroom. He is a 72-year-old sick man, Aidala said.

Aidala said he was told that doctors at Bellevue plan to run a number of tests on Weinstein before he is returned to the Rikers Island jail complex.

The lawyer said he is scheduled to meet with Weinstein on Monday. He said he plans to tell the judge when Weinstein goes to court in Manhattan on Wednesday that the trial should be rescheduled for after Labor Day.
